Employers are liable for the actions of their employees in the course of employment. Even when an employee’s behavior may be unintentional or outside of the employers’ policies, the employer may still be held liable.
Reviewing past safety-related behavior of applicants and employees, both on an off the job, is critical to ensuring a safe workplace.
Employers turn to Imperative to identify past behaviors that may predict future problems for the employer. These commonly include services such as:
Standard Driving History – This is the state’s official record of your applicant’s driving record, typically including accidents and citations in the last three to five years. Different states provide records for different lengths of time. Each jurisdiction charges fees for access to their records, which will be added to the quoted price of the report. For instance, Texas’ fee is $7.50 per report.
Drug and Alcohol Testing – We work with clients to develop substance abuse testing program for both DOT and non-DOT covered employees, including tests for pre-employment purposes, random selection, and post-accident or “for cause” situations.
In many areas, we offer online donor registration, eliminating the need for maintaining an inventory of forms, with the exception of DOT-compliant drug screens which still require the DOT-specific paperwork.
Commercial Drivers License (CDL) History Investigation – The Federal Motor Carrier Safety Administration (FMCSA) requires that employers check the driving history of candidates for defined safety-sensitive positions in each state where the driver has held a commercial license in the past three years. The Commercial Driver’s License Information System (CDLIS) is the central database used to identify in which states a driver has held commercial licenses.
Imperative will retrieve the CDL history from CDLIS and then run a driving history on your candidate in each state identified by the CDLIS. Each state charges fees for access to their records, which will be added to the quoted package price.
Driver Safety Performance and Substance Abuse History – For candidates in defined safety-sensitive positions, FMCSA requires that employers request the safety performance history of candidates from each DOT-regulated employer in the previous three years.
Additionally, specific inquiries must be made to each former DOT-regulated employer that employed the driver within the previous three years in a safety-sensitive function that required alcohol and controlled substance testing. These inquiries pertain to any alcohol or controlled substance violations and failure to complete a mandated rehabilitation program.
We will diligently request this information from each employer upon receipt of the appropriate signed authorizations from your candidate. An electronic copy of each employer’s response will be included with our report for your files.
FMCSA Pre-Employment Screening Program (PSP) Report – PSP reports include information about the FMCSA-reported crashes within the last five years and details about inspections within the last three years. An FMCSA study has found that companies that use PSP have, on average, lowered their crash rates by 8% and driver out-of-service rates by 17%. In order to retrieve PSP reports, the employer must provide Imperative a signed Important Notice Regarding Background Reports from the PSP Online Service form from each driver.
