States and local governments are creating more and more new regulations governing employers’ use of criminal history, credit, and other background information. These include restrictions on when applicants can be asked about their criminal history, what information can be considered, and even requirements that employers provide applicants with written explanations documenting how they considered the criminal history. Some jurisdictions also have special requirements for employers when ordering background checks or credit reports, including making special disclosures before or after ordering such reports.
